4.1 . The content on this Website is intended for informational purposes only. These web pages or any portions of it cannot be framed, reproduced or redistributed for commercial gain or any other purpose.

6. Limitation of liability
6.1 Under no circumstances, including, but not limited to, negligence, will RUSH be liable to any party for:
(a) any direct, indirect, special, punitive, incidental, exemplary, consequential (including, but not limited to, damages for business interruption, loss of business profits, loss of programs, or loss of information), or any other damages arising in any way out of the availability, use, reliance on, or inability to use the materials in this R/VISION Website or any other RUSH website, even if RUSH or a RUSH authorised representative has been advised of the possibility of such damages; or
(b) any claim attributable to errors, omissions, or other inaccuracies in, or destructive properties of the Website.
6.2 RUSH’s total liability to you for any claim or action arising from use of the Website will not exceed the amount paid by you, if any, for accessing this site.
6.3 To the extent that any limitation of consequential or incidental damages is prohibited by law, RUSH’s liability shall be limited to the fullest extent permitted by law.
7. Third party links
7.1 You may be able to link to third parties' websites ("third party sites") from the R/VISION Website. Third party sites are not, however, reviewed, controlled, or examined by RUSH or R/VISION in any way and RUSH is not responsible for the content, availability, advertising, products, or other materials of any such third party sites, or any additional links contained therein.
7.2 These links do not imply RUSH’s or R/VISION's endorsement of or association with the third party sites.
7.3 It is your sole responsibility to comply with the appropriate terms of service of the third party sites as well as with any other obligation under copyright, secrecy, defamation, decency, privacy, security, and export laws related to the use of such third party sites and any content contained thereon.
7.4 You should be aware that the privacy policies at the third party sites will be different from the privacy policy governing the R/VISION Website (see below). It is your sole responsibility to read and adhere to the privacy policies of third party sites.

7.6 You should direct any concerns to the administrators or webmasters of these respective third party sites. RUSH can, at its sole discretion, add, change, decline, or remove, without notice, any feature or link to any of the third party sites from the R/VISION Website or introduce different features or links to different users.
8. Submitted Materials
8.1 Unless specifically requested, R/VISION does not solicit nor does it wish to receive any confidential, secret or proprietary information or other material from you through the Website, any of its services, by email, or in any other way.
8.2 By submitting or sending information or other material to R/VISION you grant RUSH the royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully sub-licensable right and licence to use, reproduce, modify, adapt, communicate, publish, translate, create derivative works from, distribute, perform and display such material (in whole or part) worldwide or to incorporate it in other works in any form, media, or technology now known or later developed.
8.3 By submitting or sending information or other material to RUSH or R/VISION you represent and warrant that the information is original to you and that no other party has any rights to the material.
8.4 You agree to defend, indemnify and hold R/VISION, RUSH and its directors, officers, employees, agents and affiliates harmless from any and all claims, liabilities, costs and expenses, including reasonable legal fees (on a solicitor/client basis), arising in any way from your use of the Website or the placement or transmission of any message, content, information, software or other materials through the Website by you.
8.5 You also warrant that any "moral rights" in posted materials have been waived to the fullest extent permitted by law, or otherwise RUSH has your consent to deal with the material in any manner which may otherwise be a breach of your moral rights in that material. You agree and acknowledge that by using this Website, any and all communications or information transmitted by you to or through the Website will not be treated as confidential or proprietary.
9. Applicable laws/jurisdiction
9.1 By accessing or visiting our websites, you expressly agree that the laws of New Zealand, excluding its conflicts-of-law rules, shall govern these Terms. Please note that your use of the Website may be subject to other local, state, national, and international laws.
9.2 You expressly agree that exclusive jurisdiction and venue for any claim, dispute, or cause of action with RUSH and R/VISION, or relating in any way to the Website or your use of the Website, reside in the courts located in Auckland, New Zealand.
9.3 You further agree and expressly consent to the exercise of personal jurisdiction in any New Zealand court in connection with any such dispute and including any claim involving RUSH and R/VISION or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.
9.4 You are responsible for compliance with local laws, if and to the extent local laws are applicable.
